Hudson Group (HG) Retail, LLC (“Hudson”) values your privacy. In this Privacy Policy (“Policy”), we describe how we collect, use, and disclose information that we obtain through your use of the hudsongroup.com, hudsonbooksellers.com, shopdutyfree.com, and spacetrader.shop websites and the Dufry RED mobile application (collectively  “Sites”) and through our retail stores, specifically, for our customer loyalty program, and through the services available through our Sites and retail stores (collectively, the “Services”).
 
By visiting any of our Sites, using our Services, including participating in our customer loyalty program, you agree that your personal information will be handled as described in this Policy. Your use of our Sites or Services, and any dispute over privacy, is subject to this Policy and our Terms of Service, including its applicable limitations on damages and the resolution of disputes. Our Terms of Service are incorporated by reference into this Policy.
The Information We Collect About You

Information We Collect Directly From You.

  • When You Request Information from Us or Contact Us. If you contact us or otherwise request information from us, we will collect your name, contact information (e.g., email address), and any other information that you choose to provide to us.
  • When You Create An Account or Make a Purchase. Certain of our Sites offer products for sale; if you make a purchase from us or create an account, we will collect, as applicable, your name, email address, mailing/billing address, payment information (e.g., credit card number), and any other information you choose to provide to us.   
  • When Participate in Our Loyalty Program. When you visit our stores, you have the option of joining our customer Loyalty Program. If you would like to join the program and receive special offers from us through text messaging, we will collect your name, contact information (e.g., address, email, cell phone number), and any other information that you choose to provide to us.. Additional information about our Loyalty Program can be found at the end of this Policy.

Information We Collect Automatically

We automatically collect the following information about your use of our Sites or Services through cookies, web beacons, and other technologies: your domain name; your browser type and operating system; web pages you view; links you click; your IP address; the length of time you visit our Sites and or use our Services; and the referring URL, or the webpage that led you to our Sites. Please see the section “Cookies and Other Tracking Mechanisms” for more information.

How We Use Your Information

We use the information that we gather about you for the following purposes:
 
To enroll you, at your request, in our customer loyalty program, and to provide services consistent with that program. These communications will include promotions (e.g., coupons) and other information. See Loyalty Program for additional information.
 
To provide our Services to you, to communicate with you about your use of our Services, to respond to your inquiries, to fulfill your orders, and for other customer service purposes.
 
To tailor the content and information that we may send or display to you, to offer location customization, and personalized help and instructions, and to otherwise personalize your experiences while using the Sites or our Services.
 
For marketing and promotional purposes. For example, we may use your information, such as your email address, to send you news and newsletters, special offers, and promotions, or to otherwise contact you about products or information we think may interest you. We also may use the information that we learn about you to assist us in advertising our Services on third party websites.
 
 
To better understand how users access and use our Sites and Services, both on an aggregated and individualized basis, in order to improve our Sites and Services and respond to user desires and preferences, and for other research and analytical purposes.

How We Share Your Information

We may share the information that we collect about you, including personal information, as follows:
 
Affiliates. We may disclose the information we collect about you to our affiliates or subsidiaries; however, if we do so, their use and disclosure of your personal information will be subject to this Policy.
 
 Third Parties. We may share your personal information with third parties, which may use your information to market products and services that they believe would be of interest to you.
 
Service Providers. We may disclose the information we collect from you to third party vendors, service providers, contractors or agents who perform functions on our behalf.
Business Transfers. If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected about you to the other company.
 
In Response to Legal Process. We also may disclose the information we collect from you in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena.
 
To Protect Us and Others. We also may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Service or this Policy, or as evidence in litigation in which we are involved.
 
Aggregate and De-Identified Information. We may share aggregate or de-identified information about users with third parties for marketing, advertising, research or similar purposes. For example, we may share aggregate information with our suppliers, airports, and other third parties, to assist us in determining which products and services are of interest to our customers.

Cookies and Other Tracking Mechanisms

We use cookies and other tracking mechanisms to track information about your use of our Sites or Services. We may combine this information with other personal information we collect from you. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Site and Services, while others are used to enable a faster log-in process or to allow us to track your activities at our Sites and Services. There are two types of cookies: session and persistent cookies.
 
Session Cookies. Session cookies exist only during an online session. They disappear from your computer when you close your browser or turn off your computer. We use session cookies to allow our systems to uniquely identify you during a session or while you are logged into the Sites. This allows us to process your online transactions and requests and verify your identity, after you have logged in, as you move through our Sites.
 
Persistent Cookies. Persistent cookies remain on your computer after you have closed your browser or turned off your computer. We use persistent cookies to track aggregate and statistical information about user activity, and to display advertising both on our Sites and on third-party sites.
 
Disabling Cookies. Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Visitors to our Site who disable cookies will be able to browse certain areas of the Site, but some features may not function.
 
Local Storage Objects. We may use Flash Local Storage Objects (“Flash LSOs”) to store your Site preferences and to personalize your visit. Flash LSOs are different from browser cookies because of the amount and type of data stored. Typically, you cannot control, delete, or disable the acceptance of Flash LSOs through your web browser. For more information on Flash LSOs, or to learn how to manage your settings for Flash LSOs, go to the Adobe Flash Player Help Page, choose “Global Storage Settings Panel” and follow the instructions. To see the Flash LSOs currently on your computer, choose “Website Storage Settings Panel” and follow the instructions to review and, if you choose, to delete any specific Flash LSO.
 
Clear GIFs, pixel tags and other technologies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (a.k.a. web beacons, web bugs or pixel tags), in connection with our Sites to, among other things, track the activities of Site visitors, help us manage content, and compile statistics about use of our Sites. We and our third party service providers also use clear GIFs in HTML e-mails to our customers, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.
 

Third-Party Analytics and Tracking

We use automated devices and applications, such as Google Analytics, to evaluate usage of our Site and, to the extent permitted, our Application. We also may use other analytic means to evaluate our Services. We use these tools to help us improve our Services, performance and user experiences. These entities may use cookies and other tracking technologies to perform their services.

Third-Party Ad Networks

We use third parties such as network advertisers to display advertisements on our Sites. Network advertisers are third parties that display advertisements based on your visits to our Site as well as other websites. This enables us and these third parties to target advertisements by displaying ads for products and services in which you might be interested. Third party ad network providers, advertisers, sponsors and/or traffic measurement services may use cookies, JavaScript, web beacons (including clear GIFs), Flash LSOs and other technologies to measure the effectiveness of their ads and to personalize advertising content to you. These third party cookies and other technologies are governed by each third party’s specific privacy policy, not this one. We may provide these third-party advertisers with information about your use of our Sites and our Services, as well as aggregate or non-personally identifiable information about visitors to our Site and users of our service.
 
You may opt-out of many third-party ad networks, including those operated by members of the Network Advertising Initiative (“NAI”) and the Digital Advertising Alliance (“DAA”). Opting out of one or more NAI member or DAA member networks (many of which will be the same) only means that those members no longer will deliver targeted content or ads to you. It does not mean you will no longer receive any targeted content or ads on our Sites or other websites. You may continue to receive advertisements, for example, based on the particular website that you are viewing. Also, if your browsers are configured to reject cookies when you visit this opt-out page, or you subsequently erase your cookies, use a different computer or change web browsers, your NAI or DAA opt-out may no longer be effective. Third-Party Links

Our Sites and Services may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Policy, but instead is governed by the privacy policies of those third party websites. We are not responsible for the information practices of such third party websites.

Security of My Personal Information

We have implemented commercially reasonable precautions designed to safeguard your personal information. Please be aware that despite our best efforts, no data security measures can guarantee 100% security. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password for your account (in the event that you choose to create an account with us when you make a purchase), and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

Access to My Personal Information

If you would like to modify the information that you have on file with us for making purchases, you may log into your account and update your profile information. Please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages of the Site for a period of time.

What Choices Do I Have Regarding Use of My Personal Information?

Email Marketing. We may send periodic promotional emails to you. You may opt-out of such communications by following the opt-out instructions contained in the e-mail. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving emails about recommendations or other information we think may interest you, we may still send you e-mails about your account or any Services you have requested or received from us.

Children Under 13

Our Services are not designed for children under 13. If we discover that a child under 13 has provided us with personal information, we will delete such information from our systems.

Information for California Consumers

This section applies to you if you are a California resident about whom Hudson Group has collected personal information, including through the Sites, or in person through our Hudson-operated stores in the U.S. and Canada, including our Dufry stores.
For purposes of this section, “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California consumer/resident or household.  Personal information does not include publicly available information or information that has been de-identified.
A.     What Information We Collect
We may collect the following categories of personal information about you:
  • Identifiers, which may include first and last name; home or other mailing or billing addresses; personal email address; telephone numbers; driver’s license information; passport or other government-issued identification number and related information, including citizenship information; loyalty program number; username and password; social network identifiers; signature verification; and/or other account or user identification information you choose to provide us;
  • Commercial information, which may include products or services purchased, obtained, or considered;  account balances, payment or transaction history, or account activity; bank account, IBAN, credit, and debit card numbers, BIC/Swift codes, and other information relating to your financial institution; travel information, including boarding pass data, flight date, flight departure and destination, flight number, and seat number; language preferences; shopping preferences and wish lists; copies of in-store receipts; and/or other purchasing or consumer histories or tendencies;
  • Information relating to Internet activity or other electronic network activity, which may include cookie identifiers (including persistent and session cookie data), tracking pixels containing an ID number, online tracking technology, your domain name; your browser type, browser-related data, and operating system; web pages you view; links you click; your IP address; the length of time you visit our Sites and/or use our Services; the referring URL, the webpage that led you to our Sites, and/or the search terms you entered into a search engine to reach our Sites; Flash Local Storage Objects (“Flash LSOs”); Clear GIFs (web beacons, web bugs, pixel tags); third party analytics;  your computer monitor’s resolution; your Internet connection speed and other information regarding WLAN and Wi-Fi networks; Internet service provider (ISP), referring/exit pages,  clickstream data, device platform, device version, device software, including data about other software on the device, device hardware, mobile usage traffic, and other device characteristics including your choice of settings such as Wi-Fi, Bluetooth, and Global Positioning System (“GPS”) data; and information regarding social networks.
  • Geolocation data, which may include GPS data; Bluetooth location; locational information based upon your IP address; cell network data; and/or other similar locational data; and which may be collected from various devices including your mobile device(s);
  • Audio, electronic, or visual information, which may include records of calls to or from our customer service centers; video surveillance information; and photographs of purchased products; and
  • Information not listed above and related to characteristics protected under California or federal law; which may include gender; nationality; marital status; and/or date of birth.
B.     What We Do With Your Information
We may collect or use personal information about you for the following purposes:
Enroll you in our customer loyalty program and provide its services
Process and fulfill orders and purchases
Communicate with you about your use of our Services, or for other customer service purposes
Personalize your experiences while using our Sites or our Services

  • Our customers and prospective customers, users, and loyalty program members, including via our Sites, telephone, postal mail, social media, forums, message boards, chatbot, in stores, or other means;
  • Our corporate family members, including affiliates, subsidiaries, and our parent company and related entities;
  • Our service providers, including contractors or agents who perform functions on our behalf, customer relationship management providers, analytics providers, website hosting providers, systems administrators, communications delivery services, customer support providers, and distributors and fulfillment companies;
  • Other third parties, including operators of other websites and mobile applications, online advertising partners, and other data suppliers; and
  • Publicly-available information and sources.
D.     Who We Share Information With
We do not sell personal information, including that of minors under 16 years of age.
We may share your personal information with the following categories of third parties:
  • Affiliates:We may disclose the information we collect about you to our corporate family members, including affiliates, subsidiaries, and our parent company and related entities.
  • Third Parties: We may share your personal information with third parties, which may use your information to market products and services that they believe would be of interest to you, including social media, advertising, and marketing companies.
  • Service Providers: We may disclose the information we collect from you to third party vendors, service providers, contractors or agents who perform functions on our behalf, including customer relationship management providers, analytics providers, website hosting providers, systems administrators, communications delivery services, customer support providers, and distributors and fulfillment companies.

  • Information not listed above and related to characteristics protected under California or federal law
E.     Your Privacy Rights
If you are a California resident, subject to applicable law, you have the following rights under California law with respect to your personal information:
  • Right to Know.  You have the right to request what personal information we collect, use, disclose, and/or sell, as applicable.
  • Right to Delete.  You have the right to request the deletion of your personal information that is collected or maintained by us.
  • Right to Opt-Out of Sale.  You have the right to opt-out of the sale of your personal information by us.  However, as set forth above, we do not sell personal information.
  • Right to Non-Discrimination.  You have the right not to receive discriminatory treatment by us for the exercise of the privacy rights described above.  This right may be subject to the offers described in our Notice of Financial Incentives, set forth below.
You may also authorize someone to exercise the above rights on your behalf.  If we have collected information on your minor child, you may exercise the above rights on behalf of your minor child.
 
The above rights are subject to our being able to reasonably verify your identity and authority to make these requests.  These rights are also subject to various exclusions and exceptions under applicable laws.  Please note that when you submit a request, we will request your first and last name and email address, and we may require you to submit additional information or take other steps to verify your identity or otherwise certify that you are authorized to submit the request.
If you are a California resident and wish to seek to exercise these rights, please reach us in one of the following ways:
In addition, California residents may request a list of certain third parties to which we have disclosed personal information about you for their own direct marketing purposes. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for your response. You may request this information in writing by contacting us at: privacy@hudsongroup.com.  Please allow up to thirty (30) days for a response.
Depending on your state of residence, you may be entitled by law to exercise the above-described rights.  For individuals whose state of residents does not require these rights, Hudson Group may choose to offer them voluntarily and at its discretion, and reserves the right to limit or revoke those rights at any time, as may be permitted by applicable laws.
F.     Financial Incentives
We may offer discounts on products or services when you enroll in our loyalty programs.  In order to enroll in our loyalty program and obtain the discounted offers, we will ask for certain of your personal information.  The programs that may potentially be available to you are:
  • The RED by Dufry App.  Users of the RED by Dufry mobile application may gain discounts and other benefits by shopping at Dufry stores, as well as “reserve and collect” to obtain further points and discounts.  Promotions will vary depending on whether you are a member of the Silver, Gold, or Platinum tiers.  Members may obtain other discounts through Dufry stores that are part of product-specific promotions.  In order to join RED by Dufry, you will need to provide the following information:  country of residence; email address; phone number; first and last name; and a valid password.  The following additional information is optional and may allow access to further benefits:  title; date of birth; marital status; middle initial; address; geolocation information; and promotional information such as referral code, name of partner, and card number.  You may also choose to enroll by logging into your existing accounts with designated social media websites.  To opt-in to this program, please click here for the cost-free enrollment instructions.
  • Hudson Booksellers promotions.  Hudson Booksellers offers various promotions to its in-store customers, including online or emailed coupons for free or discounted items through Hudson’s publishing partners.  In order to participate in such promotions, you may need to provide the following information in the online webform associated with the specific promotion:  first and last name; email address; street address; and an uploaded copy of your in-store receipt.
Your participation in these programs is strictly voluntary, and you may withdraw your consent to participate at any time by contacting us at privacy@hudsongroup.com or +1-800.326.7711, Option #1 (Customer Service). 
 
To offer these discounts, we may track the personal information we collect when you participate in the promotions.  We calculate the value we place on the personal information that you provide as part of these promotions based upon the approximate additional revenue generated by promotion participants as compared to non-participating customers. 

Information for Nevada Consumers

If you are a Nevada resident, subject to applicable law, you have the right to direct us not sell your personal information that we have collected or will collect about you.  However, as set forth above, we do not sell personal information.
